Terms and Conditions  

These Terms and Conditions govern your use of entering the giveaway, provided by Red White and  Bloom. By accessing or using the Platform, you agree to comply with these Terms and  Conditions.

1. Acceptance of Terms: 1.1. By accessing or using the Platform, you agree to be bound by these  Terms and Conditions. If you do not agree with any part of these terms, you may not access the  Platform. 1.2. These Terms and Conditions may be updated or modified by the Provider without  notice. Your continued use of the Platform after any such changes constitutes your acceptance of  the new Terms and Conditions.

2. User Accounts: 2.1. To access certain features of the Platform, you may be required to create  an account. 2.2. You are responsible for maintaining the confidentiality of your account  credentials and for all activities that occur under your account. 2.3. You agree to provide  accurate, current, and complete information during the registration process and to update such  information to keep it accurate, current, and complete.

3. Use of Platform: 3.1. You may use the Platform for lawful purposes only and in accordance  with these Terms and Conditions. 3.2. You agree not to use the Platform: a. In any way that  violates any applicable law or regulation. b. To engage in any conduct that restricts or inhibits  anyone's use or enjoyment of the Platform. c. To transmit any unauthorized advertising,  promotional materials, junk mail, spam, or any other form of solicitation. d. To impersonate or  attempt to impersonate the Provider, another user, or any other person or entity.

4. Intellectual Property: 4.1. The Platform and its original content, features, and functionality are  owned by the Provider and are protected by copyright, trademark, patent, trade secret, and other  intellectual property or proprietary rights laws. 4.2. You may not modify, reproduce, distribute,  create derivative works of, publicly display, publicly perform, republish, download, store, or  transmit any of the material on the Platform without the prior written consent of the Provider.

5. Limitation of Liability: 5.1. The Platform is provided on an "as is" and "as available" basis,  without any warranties of any kind, either express or implied. 5.2. The Provider shall not be liable  for any direct, indirect, incidental, special, consequential, or exemplary damages, including but  not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting  from the use or inability to use the Platform.

6. Governing Law: 6.1. These Terms and Conditions shall be governed by and construed in  accordance with the laws of Michigan. 6.2. Any dispute arising out of or in connection with these  Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in Michigan.

7. Severability: 7.1. If any provision of these Terms and Conditions is held to be invalid or  unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in  effect.

8. Entire Agreement: 8.1. These Terms and Conditions constitute the entire agreement between  you and the Provider regarding your use of the Platform and supersede all prior and  contemporaneous understandings, agreements, representations, and warranties, both written  and oral, regarding the Platform.

Eligibility: 

The Giveaway is open to individuals 21 years or older and who are residents of Michigan. 

Employees, officers, directors, and agents of the Organizer and their immediate family members  are not eligible to participate in the Giveaway. 

​

How to Enter: 

To enter the Giveaway, participants must scan the QR code on the packaging or flyer to enter,  then must provide all required information on the form.  

Each participant may only submit one entry. Multiple entries from the same person will be  disqualified. 

Any entry that is incomplete, illegible, or contains inaccurate information will be deemed invalid.

Prizes: 

The prizes for the Giveaway will be specified in the promotional materials. 

The Organizer reserves the right to substitute any prize with another of equivalent value without  prior notice. 

All taxes, if any, related to the prizes are the sole responsibility of the winners.

Winner Selection: 

Winners will be selected at random from all eligible entries. 

The selection of winners will be final and binding.

Winners will be notified by phone number or social media within 4 days after the Giveaway period  ends. 

If a winner cannot be contacted or does not respond within 24 hours, the prize may be forfeited,  and an alternate winner may be selected.

Publicity: 

By participating in the Giveaway, participants grant the Organizer the right to use their name,  likeness, and entry for promotional purposes without further compensation, except where  prohibited by law.

General Conditions: 

The Organizer reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical  failures, or any other factor beyond its reasonable control impairs the integrity of the Giveaway. 

The Organizer reserves the right to disqualify any individual found to be tampering with the entry  process or the operation of the Giveaway or to be acting in violation of these Terms and  Conditions. 

These Terms and Conditions shall be governed by and construed in accordance with the laws of  Michigan. By participating in the Giveaway, you agree to be bound by these Terms and Conditions.  If you do not agree with any of these terms, please do not enter the Giveaway.
